Heritage Trees and Building in Austin: What the Critical Root Zone Really Means for Your Deck
Austin loves its trees, and the city has written that love into some of the strictest tree ordinances in Texas. If you're planning a new deck, patio, or outdoor addition and there's a mature oak, pecan, or elm anywhere near the build site, that tree isn't just a design consideration — it may be the single biggest factor in what you're allowed to build, where you're allowed to build it, and how much it's going to cost.
This is one of those areas where local knowledge actually matters. A framing crew or designer who's never worked under Austin's tree code can put together a beautiful set of plans that simply can't get permitted once a tree survey comes back. We've seen it happen. Here's what every homeowner should understand before they fall in love with a deck design.
What Makes a Tree "Regulated" in Austin
Not every tree in your yard is protected, but more of them are than most people expect. Austin's code sorts trees into a few categories based on trunk diameter, measured at 4.5 feet above grade:
Under 19 inches in diameter — not regulated. You can generally work around these without a tree permit, though other permits may still apply.
19 inches or more — a Protected Tree, regardless of species. Removing it, or disturbing its root zone significantly, requires a permit.
24 inches or more, of certain species — a Heritage Tree. This is Austin's highest level of protection. Common heritage species include live oak, pecan, and several other long-lived native trees. Even a heritage tree in good health generally can't be removed without approval from the city's Environmental Commission — not just a staff permit.
That threshold catches a lot of Austin's older, established neighborhoods off guard, because the trees that make a lot beautiful — the ones that shaded the house for 60 years — are exactly the trees most likely to trigger the strictest review.
The Critical Root Zone: The Circle That Controls Your Design
This is the part that actually shapes a deck's footprint, and it's the concept every homeowner needs to understand before falling in love with a specific layout.
The Critical Root Zone (CRZ) is a circle drawn around the base of a regulated tree, and the radius is simple to calculate: one foot of radius for every inch of trunk diameter. A 20-inch tree has a 20-foot CRZ. A 30-inch heritage oak — not unusual in older parts of Austin — has a 30-foot CRZ, meaning a 60-foot-diameter circle of protected ground centered on that single trunk.
Inside that circle, the rules get progressively stricter the closer you get to the tree:
Full CRZ (the whole circle): at least 50% of the ground inside this zone has to be preserved without impact. You can dig or build in the outer portion, but it's a balancing act across the whole circle, not a free pass everywhere inside the line.
Half CRZ: no cutting or filling the grade by more than 4 inches, and any work planned here needs specific approval during plan review.
Quarter CRZ: no disturbance allowed, period. This ring closest to the trunk is essentially off-limits to construction.
For a deck project, this changes the conversation immediately. Footings, post locations, beam spans, even where equipment can drive or where materials can be staged all have to be mapped against these circles — not just for the tree closest to the deck, but for every regulated tree whose CRZ might overlap the work area, including ones on a neighboring property.
Why This Changes the Structure, Not Just the Layout
Here's where tree preservation stops being a landscaping issue and starts being a structural engineering issue. If a heritage tree's CRZ crosses the footprint of a planned deck, standard footings placed on a normal grid often aren't an option — they'd mean digging through root zones that the code protects.
The typical solutions:
Spanning over the CRZ with a longer beam, supported by footings placed outside the protected zone, so the deck effectively "floats" over the root area without any posts landing inside it.
Helical piers or other low-impact foundation methods in the outer portion of the CRZ, where soil disturbance can be minimized compared to a poured concrete footing.
Redesigning the deck's shape entirely — pulling in a corner, shifting a stair location, or reducing the footprint — to get post locations outside the protected zones altogether.
Any of these options can mean bigger beams, fewer but more heavily loaded posts, and structural engineering that a standard deck permit wouldn't otherwise require. That's a real cost difference, and it's one that's essentially invisible until someone walks the site with a tape measure and a tree survey.
The possibility always exists that once footings are located and digging begins, a root of substantial size is revealed. This event requires a redesign and pivoting to a new footing location, and possibly a redistribution of the structural load. We expect to be flexible inside the root zones in which we work, and we usually find a way to move forward without a lengthy delay.
What Homeowners Should Do Before Falling in Love With a Design
If there's a tree anywhere near your planned deck site that looks like it might be more than a foot and a half across at chest height, don't finalize a design before it's addressed. A few things worth doing early:
Get a tree survey before, not after, the design is finished. A licensed arborist or your builder can measure trunk diameters and plot CRZ circles onto the site plan before you've fallen in love with a specific footprint.
Ask whether a Tree Ordinance Review Application (TORA) will be needed. Many building permit applications in Austin require this as part of the standard process once regulated trees are on or near the site — and reviews can take time, so building it into the schedule early avoids surprises later.
Expect the permit process to take longer, not because anyone's being difficult, but because heritage trees genuinely require more scrutiny. Removal or significant impact to a heritage tree, even one that's healthy, generally requires Environmental Commission approval rather than a routine staff sign-off.
Build the framing budget around the possibility of a redesign. If a CRZ overlaps your build area, plan on the framing scope shifting — bigger beams, different footing types, or a smaller footprint — rather than assuming the first sketch is the final structural plan.
The Trees Are the Reason People Move Here
It's worth saying plainly: none of this is red tape for its own sake. Austin's tree canopy is a big part of why people want to live under it, and heritage trees in particular take decades — sometimes a century or more — to reach the size that makes them worth protecting. A deck is worth building well. It's also worth building around the thing that was there long before the house was, and will hopefully still be there long after the decking boards have been replaced a few times over.
